Michigan spousal abandonment question.?
Q. My mother left my father 24 years ago. He gave her the house they bought. She gave him divorce papers and he signed and returned them to her...she never filed them. He passed away a couple of months ago. Does she have a legal claim to any of his remaining estate? When she left my father, she also left 3 minor children with him. One of my sister went to live with my mother and then returned to live with my father. She never paid him child support, nor did he ask or expect it. However, because she only worked part-time, he did give her grocery money for at least 5 years.

A. Really, none of that matters. He is the father and he is responsible for paying child support and he is entitled to visitation. You need to go to court and ask for a child support order from him so that he supports his child. He can ask the court for a formal visitation schedule but it's not likely that he will if he has shown no interest in the child and has asked to relinquish his parental rights. You do not need an attorney to file for child support. You can go to the state child support agency or simply file yourself in court. The court will not allow him to relinquish his parental rights until there is another father figure willing to adopt the child. Q. If the breadwinning spouse (who was the breadwinner because he was controlling and didn't allow the other spouse to work for years and deprived of the other spouse of a vehicle/phone, etc, leaves the house and takes all of the money and doesn't file for divorce, is there some kind of rules that say the spouse who left is neglecting the needs of the other spouse? and FYI, this is not my situation, it's for a person that I know, as I'm not married yet. He has left the house and moved out on her. Actually, it was vice versa, he is a drug addict and an alcoholic and I have heard her be verbally abusive and have seen her bruises. Is spousal abandonment illegal in the state of California?

Does anyone know anything about spousal abandonment laws in TN?
Q. Such as how somebody proves they were abandoned and that they didn't agree mutually? Is there a time frame that two people have to be married for this to be grounds? What if she was living somewhere and he moved in with her and they didn't have any assets or anything together and when it was over he just moved out? She is trying to make him pay half the bills and things after he left and they were only together for a month after marriage. So basically what needs to be done to fight this, or is there a way? Ok, I am not the one getting the divorce. My friend is, and he is the one being accused of abandonment even though that is very far from the truth.

If you claim spousal abandonment on a divorce, and you don't know where they are to serve divorce papers?
Q. what eventually happens to the spouse? I mean, if they abandoned their wife and changed addresses and their job and one was unable to serve them with divorce papers... then does the government try to keep track of the spouses whereabouts? What are the consequences of abandoning a spouse in regards to divorce? I can file divorce but I don't know his address to serve him the papers. So what about all the money he owes me? Will the government somehow keep track of it and obtain it or what?

A. this one is easy let your lawyer know that you don't know his whereabouts he should have you fill out a divorce paper it will appear in the newspapers and if he doesn't contest it then you get anything you want...you can include that you want alimony totaling what he owes you and yeah the judge will grant you anything since he is showing no regards to taking responsibility...once it goes thru using his social security it will most likely get taken out of his tax return unless they track his ssn and find his job...but the irs will take it from him to give it to you...if you don't have a lawyer make sure that you ask the county clerk for the right forms for spousal abandonment...good luck!

My 4.5 years common law went to another country for 5 weeks already and hasn't come back since. I havent heard anything from him. Q. I just wanted to say thank you all, especially Annie, you are right, jerks like that have to pay up. I had feelings for a long time even though he did horrible things abandoning and threatening me. Not anymore. I will fight and he will have to support me now that I am disabled. can I get spousal support in my divorce?
Q. I am filing for a divorce for domestic abuse, adultery and abandonment, can i get spousal support if he earned more money than me the 7 years we were married?

A. Yes, you can. It just depends on the state you are in. Each state has its own rules about alimony, how much is awarded, for how long, etc. If you earned more money than him its quite likely you'd be awarded it, but again, it just all depends on your state's laws. Now, whether or not he's going to pay it is another story. If he's that swell of a guy, he'll most likely avoid paying it. However if you have court ordered alimony and he refuses to pay it, he can get hard... (again depending on the state) he can have his drivers license revoked, or worse, put in jail! A. People leave their spouses and families all the time. There is no law that forces a person to stay with anyone. Therefore it is not illegal to abandon your spouse or family. What becomes illegal is if your spouse or family, as in children, go to Court and get a judgement of support against you after you have abandoned them and you fail to pay the support. In jurisdiction like California, dead-beat Dads can be put to jail on contempt of Court for failure to pay. There are other consequeces such as wage garnishmnet, liens placed against homes the abandonee might own, interception of their Income Tax refund, cancellation for their driver's license. A. I don't understand a few things. Were you denied alimony during the trial? Did you not appear for trial & he received everything he petitioned for by default? These things will matter to a judge. If you were previously denied, you need to show "a real and substantial change of circumstances" such that judgment. If you never showed up at court, you will need to have a very sound reason why you weren't there in order for the judge to reverse the decision. Here are some legal sites regarding alimony in DE. You can go to your county clerk's office to obtain forms for "Alimony modification." The fee, if any, should be nominal. pregnant spousal abandonment?
