Where can I find 2008 IRS Principal Business Codes?
Q. Every list I have found includes "516110 - Internet publishing & broadcasting", but Turbo Tax is claiming this is "no longer a valid Business Code", so I assume these lists are out of date. Where is the official 2008 list of Principal Business Codes, and/or what code would an Internet Game Site fall under in 2008?
Asked by skatc - Sun Feb 8 14:14:28 2009 - United States - 2 Answers - Comments
A. The official 2008 list is at page 116-118 or in the instructions for the 1040, pages C-9 through C-11. Internet publishing & broadcasting is 519100. Gambling is 713200.

A. Called again today (21 days since I filed) and the rep informed me that they are manually setting up the re-payment program and there is still no estimated date as to when we will get our return. (This totally screws up my plans this spring!) But we've got to sit back and wait...no other option.

A. FINALLY!! Money in the bank! For all of us that had the 1121 reference code and was suppose to get our direct deposit on 1/26 and didn't, then it was switched to a 1201, well, it's finally pay day! The IRS released money today 2/15 to the distributing banks (depending on what tax software you used) and I confirmed with the bank that HR Block software "Taxcut" uses and it's there! Wahooo! or more appropriately Yahooo! So what I want everyone to know, with that reference code 1121 and 1201, your money is as good as there.

A. I actually also had a 1201 code. I filed my taxes on Jan. 16th, I was told I would get my refund on 1/29/10. For some reason on 1/28/10 I checked the wmr and the status was your refund will be delayed due to 1201. I called the irs, no one knew anything, I finally got a tax advocate, and she looked into it for me, and mine was because I filed electronically and didn't furnish my W2 and i got back a big EIC, so I had to fax my tax return and my W2, they cancelled the hold on my refund on 2/4, and released my funds on 2/11, but I still haven't seen any money. I was told a 1201 is a catch-all when nothing else fits. When they want to manually review (not audit) your refund. Good luck to you, and keep us posted.

What is section 528 & how does it compare to section 277 of the IRS code?
Q. Why would a homeowner's association (a non-profit) choose to file their federal returns under section 528 as opposed to section 277? What are the advantages? What are the disadvantages? Would the IRS website give me access to the tax code?

Membership organization formed by a real estate developer to own and maintain common green areas, streets, and sidewalks and to enforce covenants to preserve the appearance of the development may be exempt as a social welfare organization if it is operated for the benefit of all the residents of the community. Are these questions to the IRS logical and reasonable?
Q. A person goes into the IRS office with a 1040 filled out except for the signature. The following questions are proposed: I am not sure if I am required to fill out this 1040 Form. My friends told me that I must. What is the Code section that indicates a Form 1040 is required? Before signing the form, I read on the Form that I would be signing it under penalty of perjury. By signing the 1040, would be giving up my right to be silent under the 5th Amendment ? (A suspected murderer would not have to do or say anything.) Will an IRS offocial sign a statement, under penalty of perjury, indicating my requirements and the Chapter and Section that states my requirements? A. If I were the "tax man" at the counter, this is what I would say to you: Your friend is right. If your income meets minimum requirements, you are required by law to file a return. Filing requirements are specified in section 6012 of the tax code, as approved by Congress. Since you've filled out the 1040 form in good faith, you have no applicable 5th amendment rights. You haven't committed a crime, and so you're in no danger of self-incrimination. However, if you fail to file (or sign), we will choose whether to pursue action against you. When you appear in court, you have the right to remain silent throughout as we lay out our case based on evidence we received from your employer, 1099's issued and your past returns. A. 1221 could mean that someone is looking at some thing that was entered on the income tax return and reviewing the information before the final decision is made about the delivery or the day that the IRS will send out the anticipated REFUND amount that is expected to be sent out early AM on some Friday morning when they finish the review or whatever is going on with this income tax return to the satisfaction of the IRS office. Hope that you find the above enclosed information useful and good luck to you.

Do Businesses Required Churches to Have IRS Determination letter before they will donate?
Q. I understand Churches are not required to apply for exemption because they are automatically exempt under IRS code. However, in the real world of business, I would like to know if donors such as other nonprofit, and for-profit businesses require "CHURCHES" to provide an "Irs tax determination letter" before they donate though other nonprofits are required to by businesses.
Asked by John - Tue Apr 7 15:01:07 2009 - United States - 1 Answers - Comments
A. In my real world experience, churches generally do not apply to the IRS for a determination letter proving they are exempt from income taxes because (as you noted) they are not required to do so. Thus, potential donors don't ask churches for a copy of their IRS letter, since most churches don't ever get such a letter. Churches often will apply for a state certificate proving they are exempt from sales taxes, since that helps in purchasing everything from paper clips to pipe organs. If you own a business that is considering contributing to a church, you might ask to see their sales tax exemption certificate as a second-hand way of checking their nonprofit status.

Are medical benefits paid to volunteers taxable income under the IRS Code?
Q. If a rural fire department that has volunteers, not paid employees, decides to provide the volunteers paid health insurance, or other non-salary benefits, are these taxable income? And, do they trigger workers compensation issues in Idaho?
Asked by Oliver D - Mon Dec 21 16:18:32 2009 - United States - Answers - Comments
A. Dear OD: The employer(fire dept) will be able to tell you. If they are not up to speed look at the IRS "Taxable Fringe Benefits Guide". This pub explains how fringe benefits work and which are taxable which are deferred and which ones are exempt. Most health insurance plans paid for by the employer (if you are a volunteer, you are considered an employee for this determination) are tax exempt. The same applies to "de mininimis benefits" such as coffee at the firehouse. Q. If a rural fire department that has volunteers, not paid employees, decides to provide the volunteers paid health insurance, or other non-salary benefits, are these taxable income? And, do they trigger workers compensation issues in Idaho?

A. I got this also. My Taxact.com return was accepted on the 19th, and up until the 26th, I showed a direct deposit date of 1/29. After that, I have since been getting the same reference 9001 message. Today I had the free thirty minutes to call, so I did. Here is the answer I received. "I know this sounds kind of lame (I swear, that's what the IRS guy said!), but basically there is nothing wrong with your return. Our computers could not handle the amount of refunds it received, so some got resequenced and essentially delayed until the 11th. Unfortunately, yours was one of them." So, due to no fault of our own, we are pushed back because they can't handle it. Dontcha just LOVE the IRS. BTW, he indicated to keep checking back, and… [cont.]

Ive received a letter about discharging a debt over $600 using section 6050p of the IRS code. Am I in trouble?
Q. This financial instution has been trying to get us to pay for something that I thought we had paid up. We were never contacted until 3 or 4 yrs later, after this place of business either got sold or changed hands. The place called us sereval times to get their money. I told them that the bill was paid. This instution was a loan company. I told them I wanted a bill or a copy of everything that we paid. They never sent it. They called again about 6 months later and I repeated myself again about I wanted a copy of what we had paid. Now they have sent me this thing for the IRS. Something about section 6050P of the IRS code requires that they report the discharge of any debt over $600. Are they going to hijack my taxes or what

A. If you're absolutely sure you paid off the balance in full, try to find proof and submit to the IRS, either separately or with your return. Reporting a discharged debt is no big deal. Any debt that has been discounted by $600 or more must be included in your income (AGI). But by the time you minus standard or itemized deductions to reach your taxable income, you might not even notice it at all. Depending of course how much over the $600 they forgave and your actual income. Don't sweat it.

How do you plan to change the IRS tax codes to make them more fair, and less complicated?
Q. Do you plan to replace the itemized deduction for mortgage interest? Do you plan to allow the deduction for charitable contributions to be removed?
