A. Head of Household is reserved for unmarried people who have a child or dependent relative. It is also for Married people who have not lived with their spouse the last six months of the year, have kept of a home which was also the main home for his/her dependent child. The exception to dependent child is only if the custodial parent released the exemption with an 8332.

If I filed taxes this year and my parents claimed me will i get stimulus check?
Q. I made about 5,000 dollars working and I filed taxes. My parents also filed with me. Do I get a check?

A. Sadly you will not personally get a check if you rparents claimed you. If you are under 17, your parents will get some, but if you are over 17 they will get nothing either.

How many people filed their taxes today or in the last day or two?
Q. Is there a reason? I filed my Federal and State returns in February as soon as I had all my paperwork in hand. I mailed my local taxes this morning - on purpose - because I had to pay a hefty check (my old employer didn't withhold any local taxes). I'm just wondering why folks wait to the last minute - especially if you are getting a refund. I totally understand if you owe.
Asked by nova_queen_28 - Tue Apr 15 12:28:10 2008 - United States - 6 Answers - Comments

A. I filed mine on Saturday. I'm getting a decent amount back, more than I thought I would. I think the main reason people wait is simply procrastination! We all think, "I've got time, I've got time"...and before you know it, April 15th has crept up! Another reason could be that people want to wait awhile before they get their refund. That way, it gives them something to look forward to, and they don't spend it early on.

Can I file my state taxes for the year 2005 if I already filed my taxes and got my return for the year 2006?
Q. I never filed my states taxes for 2005 (I live in Montana). So I know I should get a nice return if I can file them. I already filed my state and federal taxes from 2006 and got my return. Can I still file my state taxes for the year 2005 even though I already filed for a return for my 2006 taxes?
Asked by #3729684317950-48217 - Sat Feb 17 15:32:25 2007 - United States - 6 Answers - Comments

A. Yes you can still file. The time limit is three years. Expect a penalty for late filing and some interest. Get with it so you can get your refund for 2005. I live in Montana too. Great Falls.

How do I file for emergency temporary custody if my wife filed for divorce?
Q. My wife is using meth, although I cannot prove it. She told me she filed for divorce and child support already. I want to get temporary custody until the divorce hearing etc. How do I do that if she already filed? Will they make her drop if my reason for temp. custody is her using drugs?
Asked by - Sun Dec 18 04:36:59 2011 - Marriage & Divorce - 2 Answers - 1 Comments

A. You go to the court and request emergency custody due to alleged drug use and that you will pay for her to take a drug test. Give her 24hrs notice do a hair test not a urine test...if she doesnt go take the test its then considered dirty. The cour will agree to this...I did it to my ex...he didnt show up so now I am full time mom and very happy about that...she is safe with me now

What happens if I filed my federal online and by mail?
Q. I filed my taxes online yesterday and was rejected because I used the wrong AGI amount. I fixed it and resent it but I am uncertain of the status so I sent it the paperwork through mail today. What happens if the IRS receives two identical returns?
Asked by bigmagiccat - Tue Apr 17 16:21:25 2007 - United States - 4 Answers - Comments

A. You should get confirmation from the IRS confirming receipt of the electronically filed return. Once you do call the IRS and notify them that a "True Duplicate" return has been sent via the mail, they can notate your account to help avoid delays in the processing of the efiled return 1-800-829-0922

OH, a shocker , they actually added some interest to the refund!!! Wasn't as much as they add on if you owe them , but I will take it anyway. LOL!!

A. I'm not a CPA or a tax lawyer, but this is all common sense. If he's been working all these years, the IRS will eventually catch up with him. He should contact the IRS himself, before they contact him. Apologize and try to work something out. All of us have to pay taxes. Good luck.

I already filed my taxes and received a 1099 MISC form for non employee compensation what do I need to do?
Q. I did not work for this person and I think she filed it for her own purposes. Everything I received from her was monetary gifts. I already filed and received my return from the IRS do I need to file an ammendment on my taxes? I am very confused about this. I have no idea where to start.
Asked by Alisa M - Sun Mar 2 12:43:05 2008 - United States - 5 Answers - Comments

A. The only way she can issue you a 1099 is that you received over $ 600 for services you rendered to her. Attorneys and pedicures can be 1099. Real estate agents are also 1099. 1099 are issued to those who take care of their own taxes. This way, as an employer you are not responsible for withholding taxes like you would have with an employee. The only way she can issue you a 1099 is if she has your social security number or your Federal ID number. Basically, to receive a 1099 you were some sort of a contractor to her, you provided a service worth over $ 600. The maximum amount a business can give $ as a gift is $ 25 only. Anything beyond that is no longer considered a gift but an expense. If you file an amendment to your taxes to include… [cont.]

Filed for Efile electronic sitmus tax rebate and what happens now?
Q. Ok, disabled and filed for rebate electronically. I do not want to call my tax preparer for a stupid question. An email came from IRS stating approval of filing. However, it also said to go to "check statis" to confirm. Since it was approved by IRS. do I have to do anything else to get it approved? Yes, I do have to respond to the emails sent by IRS and not to tax preparer. Strange as it is, please just answer if I need to do more after the approval email Thanks, you are so good to me.

A. I am sure you are asking about the Stimulus Rebate. All you have to do now is sit and wait. The IRS will compute the amount you are entitled to and mail you a check. Visit www.irs.gov and in the middle of the page near the top is a section with Stimulus Information. A lot of good information there that should answer all your questions. The Stimulus checks will start being maile early May and to until almost the end of July. The IRS web page has the when and how dates on the too.

Can unfiled taxes from prior years be filed to be current?
Q. What is the annual income maximum, that a person can make and not be required to file taxes? If someone has not filed taxes in the past 6 years, can they file them now and get caught up? If so, how? Also, if a person does not have W-4 forms for that time period, how would they get copies of them. If they are unable to get copies, how do they know what amounts to use for filing. Thanks.

A. Call irs at 1-800-829-1040, for assistance. If you do not have your wage information (W-2 or 1099) call the above phone number, and they will send them to you for free. They will give you a certain time to file the returns such as 30 days from the date you call. Will they will let you know what years you are required to file, by looking at your wages. Eventually you will be getting a letter from IRS requesting you to file the returns or they will file them for you and you will owe lots of penalties and interest. You will not get refund for the tax year 2003 and prior, but you are required to file it anyway. call IRS and get current.

How wife should file if I filed head of household?
Q. I filed Head of household because we were considered unmarried due to living apart for over a year and I paid all of finances for home and dependents. What I need to know is how my wife should file now. Single or married separate.
Asked by Alex L - Tue Feb 17 17:02:04 2009 - United States - 4 Answers - Comments

A. NOT enough info. You may only file HOH IF you were married and lived apart the year, and have dependents. If you have no dependents, you MUST file MFJ or MFS, same for Wife. Need to get divorced to change your fiing status. How you file does not control how wife files.

What happens if you filed as single but should have filed as married?
Q. I got married outside of the US to a foreign national. I lived and worked in the US up until August of last year then left the US to move to my husband's country. My parents filed my tax claim in my absence but they filed me as single instead of married. I've already received my return and wasn't audited but I'm wondering if there is any way the IRS could find out that I filed mistakenly and if I could be penalized for it (i.e. when I send them a copy of my marriage certificate in order to have my last name updated in their records). Thanks in advance.
Asked by Double 709 - Tue Aug 7 21:45:25 2007 - United States - 8 Answers - 1 Comments

A. You need to file an amended return. Since you were married, you cannot file as Single. Unless your non-resident alien husband agrees to have his income taxed by the US as well, you must file as Married Filing Separately. Get a copy of Form 1040-X and file the amended return. You will be facing penalties and interest on any tax due and these will continue to mount until you file the amended return and pay the tax due. The mere fact that you have not been audited YET means nothing. The IRS has until April 15, 2010 to audit your 2006 return.

A. The stimulus is separate from your 2007 tax return. They actually need your 2007 tax return to be in the system to figure out what you will get if/when the checks are issued in June/July.
