How long can you wait till you get a dismissed crime expunged?
Q. **For a federal government job, you cannot even have had arrests right? I got a Misdemeanor class C dismissed 5 years ago and want to know if I can still get it expunged.. Eventhough it was dismissed, it still shows up on my record as dismissed. I want it to go away completely. I am studying languages right now and wish to be an interpreter for a big agency and don't want this to hold me back. I've worked for the federal government before and I know they perform a very thorough background check.. Would this even matter for a background check like that?

A. A case that was dismissed shouldn't keep you from getting a job with a government agency. However, if it's a job that requires a very thorough background check and Top Secret clearance, then you may get passed up for other candidates with cleaner records.

Will a dismissed misdemeanor affect my ability to go to law school and become a lawyer?
Q. I received a minor consumption of alcohol charge when I was 20 years old. I was put in a diversion program which required me to complete community service, pay a fee, and the prosecution dismissed the case. I am wanting to go to law school. I was wondering if any of this would affect my future of wanting to be a lawyer. There will be no conviction on my record, but the arrest will still be on there. Should I try to get it expunged?

A. You shouldn't bother trying to expunge your record. The bar can still find out and asks you to report expunged crimes anyway. If you get caught lying on your law school application or bar application, even on an expunged crime, and the bar finds out, that'll be a MUCH bigger deal than the crime itself. Alcohol-related crimes, even DUIs, are much less serious than so-called "moral" crimes, like theft or academic dishonesty, like plagiarism or cheating. I can't promise anything, of course, but I would be very surprised if a misdemeanor at the age of 20 is going to affect your law school chances at all. You can call the state bar or the law schools that you're interested in, but all they're going to tell you is to disclose… [cont.]

A. You shouldn't bother trying to expunge your record. The bar can still find out and asks you to report expunged crimes anyway. A. You have to go to the courthouse and get a petition to expunge/ seal records and fill it out. You might have to pay about $100 in fees for finding the record and processing. (stinks, I know, especially since you really didn't do anything wrong!) They will contact you with a court date, and if all goes well it will be expunged.

Although i was fairly dismissed (breach of the health and safety rules), i am still working with my rep to gather a case together and take this to appeal. I don't know what my chances of being let off with a written warning are but i believe i have nothing to lose now in trying. However i am concerned that if i lose the appeal, how will this affect my future chances of getting a job. Any advise helpful. Thanks.

A. Well, unless you tell a perspective employer why you were dismissed, it is not likely that he or she will every find out. Most business by policy only verify that a person was in their employ and do not say anything as to why they left. I would if I were you tell the truth without giving details. For example you might put as to why you left...Dismisse d...disagreemen t over conduct.

Now he doesn't exactly have alot of money so is this something he can do personally or does he need a lawyer. And how long will it take him to do it personally, than to have a lawyer do it. You can contact the Clerk of Courts for that jurisdiction and get the proper forms to submit to the court to expunge the arrest record, pay the filing fee and submit it for consideration. Not being a lawyer, it will be some running around in not knowing the system, but you can do this on your own. Best of luck and I hope you can find this useful

I was recently dismissed from my doctoral program due to not finishing my dissertation in the required time?
Q. I was recently dismissed from my doctoral program due to not finishing my dissertation in the required time. I had been given an extension, but still was unable to complete it. I had a 3.7 GPA. Is it possible for me to complete my requirements at another institution or is that impossible I have completed all coursework. I've completed my doctoral internship and all other requirements, but the dissertation.

A. Another school might accept you as a transfer student. In that case, don't expect them to accept all of your completed coursework. However, repeating several courses and finishing in a year might be better than not finishing at all.

A. It depends upon the courts, the defensive driving class, and the back-log between the two. Your best bet is to contact the courts and ask them. There should be a phone number on the back of the ticket.
