What is the possibility I would get discharged from the army?
Q. I was hearing rumors that the army is trying to cut back on personnel and I was planning on joining next month when I turn 17. I dont want to enlist if their is a high possibility I would get discharged after enlisting. I heard many rumors about people being discharged for no reason so thats why I am asking.

A. Nobody ever gets discharged for "no reason". It's more likely that they were discharged for a reason they didn't want anyone else to know.

A. A Dishonorable Discharge (DD), like a BCD, is a punitive discharge rather than an administrative discharge. It can only be handed down to an enlisted member by a General Court-Martial. Dishonorable discharges are handed down for what the military considers the most dishonorable of conduct. This type of discharge may be rendered only by conviction at a general court-martial for serious offenses (e.g. desertion, sexual assault, or murder, etc.) which call for dishonorable discharge as part of the sentence. With this characterization of service, all veterans' benefits are lost, regardless of any past honorable service. My bankruptcy has been discharged. Can a cosigner I had on a loan come back on me and sue me?
Q. I filed bankruptcy a couple years ago. This bankruptcy has been discharged.However my ex wife co signed on a loan for a vehicle while we were married. I filed the bankruptcy after the divorce. It has been discharged and I am free of this debt. My ex wife wants to take me to civil court for this loan because since I filed bankruptcy they then came after her the co signer. Is she able to sue me for this and win?

A. If you still have the car then she can probably sue, and win, if the car is no longer in your possession then it will depend upon the divorce agreement. Other things to consider is how long after you got the car did you file for bankruptcy? if it was just a couple of months then she may be able to make a claim that you intended to defraud her. If it were me and I still had the car, I would give it to her, if you keep it and she has to pay then you can be found guilty of unlawful enrichment and lose the lawsuit. How can you get discharged from the Military without it being dishonourable?
Q. I've got a character who is a young FBI agent with a previous background as a Marine Core Soldier. He was discharged from the Marines early-if wounded severely would they discharge you? How could he possibly get out with his reputation unscathed? I was wondering if you could be medically discharged?

A. It would be difficult for somebody to be discharged early from the military yet still make it through the intense competition for a job as an FBI agent. The only type of 'early out' that would not look bad would be medical. And a medical discharge would raise questions as to whether or not he is healthy enough to function as an FBI agent. Another option is if he were accepted by the FBI and was then granted an early discharge in order to attend the FBI academy.

A. In order to get a Dishonorable Discharge, you have to be convicted in a court-martial. Things that could get you a DD are rape, murder, desertion, and a couple of other things that would be the equivalent to felonies in the civilian world. Without a court-martial, the worst discharge you can get is an Other Than Honorable.

Is there a loophole for someone medically discharged from the military to excuse a car loan?

A. Unless you bought a disability insurance company on the car loan, you still owe regardless. Unless they happened to allow you to put an asterisk next to your signature saying you only have to pay unless you are medically discharged. (And no lender would do that) You can try asking the bank to lower your payments and/or your interest rate to avoid a repo. Some are willing to so something to avoid a repo but they cant work miracles. Banks want to get paid. When they repo a car, they lose thousands of dollars so they would prefer to avoid repoing a car. But, if your note is $450 a month and the most you can pay is $200, they arent going to go for that.

A. Well.. To have it removed from your credit reports, complain to the credit report companies and demand that it be removed. As to the records at the county hall, take a copy of the bankruptcy showing the discharge of the debt and demand in a nice way that they modify the record to show that the lien was discharged.

A. It depends on the kind of discharge (General Under Honorable Conditions is in a way getting fired from the military), and how much you support the military. I think that the laws are there to protect reservists and national guardsmen that have been activated and need to get out of their lease in a hurry. Those laws also protect the guardsmen from unwarranted bill collectors and from loosing their jobs to somebody else while serving and being called up. Because you said "A TENANT" I am to assume this tenant was single and did not want to live in the barracks. A. Auto finance is what I do for a living and this is very strange. I would have to say since they have made no effort to take the car they must think that it's not worth the time and money to take it back. This leaves you hanging though, without a lien release you can never have a free and clear title so while you can tag and drive the vehicle you can not sell it. I would call them if I were you and see if you can work something out. Good luck.

A. I have been through this and the best way is with credit cards. I used two for every day things, never exceeded 30% of my credit limit in any given month and paid in full before the due date. By doing this I raised my credit score over 150-points in 24-months, was able to buy a car and a home with no down payment and low interest rates.
