Q. how long does the non custodial parent have to be gone for before it is officially considered child abandonment? My ex is running from the law (absolutely zero contact with me or his kids) and I was wondering how long he has to be gone before I can do...something...I don't know what, but I don't want him to be able to just show up whenever expecting to see the children. Oregon Abandonment Laws? How long does a parent have to NOT be incontact?
Q.
Asked by Stacie - Thu Jun 25 17:01:17 2009 - Law & Ethics - 2 Answers - Comments
A. Abandonment is not just one-size-fits-all general category. Are you talking about leaving a child without care? Leaving a child with strangers? Leaving a child with friends or relatives for an extended period? Or even when a non-custodial parent simply does not exercise visitation? The process and consideration of each of those situations affects the determination. And I mention the last one since some custodial parents erroneously believe that lack of visitation constitutes legal abaondonment. But, for the others, except where a child is left without care and is considered immediate abandonment, they're subject to review for purposes of terminating parental rights, and no time period is automatic.

Know of a reputable source for Texas laws pertaining to Abandonment/Seperation in marriage?
Q. I in need of a good source of information about the Abandonment and Seperation laws in the manner of Marriages. My mother is in need of a divorce to a crazy man but cant pay $900 bucks for it... so trying to find some alternatives that will give her as little grief as possible. Any help is welcome. Thanks!
Asked by christiechritter - Mon May 1 16:10:16 2006 - Law & Ethics - 1 Answers - Comments
A. Texas law states that the court may grant a divorce in favor of one of the spouses if the other left the spouse with the intent of abandoning him/her and has been gone for a year. Also, it can grant a divorce in favor of either spouse if they live apart for 3 years. There would still be filing fees, but most courts have fee waivers for people who can't afford the fees. Check your local family court.

Q. My estranged husband is refusing to see our baby and is no longer giving me any money for him. Someone told me that I could charge him with child abandonment. Is this true?
Asked by baybeegirl - Tue Aug 21 23:23:43 2007 - Law & Ethics - 3 Answers - Comments
A. Off the top of my head, I think not. Child abandonment usually means something along the lines of leaving your child alone at the bus station. But you do have rights. See a lawyer or the Alabama Department of Human Resources and start getting your child's support out of this deadbeat dad.

A. each state has it one rules on this matter, look up south carolina and then hit child support section. in a couple of states this is still NOT classed as abandonment [sadly] just because there is a support order in place regardless of if the db has paid or not. You could ask at the child support office dealing with your claim , they might be able to put you in the right direction. if the case is based in NC then those are the laws re child abandonment I would read first...also it might be worth a trip to the local city courts, see if the have any one that does family law that will give you the first visit for free, ask them if you can do anything as a 17 to be allowed to have your step father adopt you, failing that could you at least… [cont.]

Ohio abandonment laws, and adoption.?
Q. I married a man with 2 children from his first marriage, his ex wife has not seen, talked, or tried to contact us in a year and 8 months. she pays child support, but we don't need it. He is the residential parents, and if he doesn't agree with the circumstances of the visitations then she can't have them. I was wondering what is considered abandonment in Ohio, and what i need to do to legally adopt my step children?
Asked by Daniy Conklin - Sun Jul 17 21:24:37 2011 - Adoption - 1 Answers - Comments
A. I'm a little concerned with the "if he doesn't agree with the circumstances of the visitations then she can't have them." That would denote a level of denial of access. Have you been clearly documenting the efforts you have made to have her maintain contact? Have you recorded conversations with her in which you have asked her to spend time with the child? This is legal in your state. Ohio Rev. Code ann. SS 2933.52 Also keep a Daily Journal. I would suggest each of you join these groups, respectively. We should have some members in your state for additional help.

Abandonment laws in california?
Q. I know that if for example the father has nothing to do with the child for 2 years, then the mother can legally file abandonment. However that is in Washingtion state. Does anyone know how this law works in California? My son is 5weeks old, and the father has only tried to see him 3 times(all in the first week that he was born) and has not offered to pay for anything. The father has not even made a phone call in 3 weeks.

A. What you should really do is go to the Child Support Agency and file all the paperwork necessary so that you can start getting some child support. If he is working you will get it. But you do need to prove he is the father thru the court system unless you have the child's birth certificate with his name on it and the father has acknowledged that he is in deed the father. He is just a dead bead father who thinks that he has no responsibilities, just like many others. And they get worse, he might not see the baby for months. Just make sure you take care of yourself and your baby and get that child support, which will come in handy. Visit their website at www.childsup.ca.gov best of luck!

What are the personal property abandonment laws?
Q. My ex and I bought a house together and over a year ago he broke up with me, and he moved out to a different state. He took what he could in his car when he moved but left everything else in the house. It's been over a year and we have both moved on. I've talked to him about getting his stuff out and there's always an excuse money. He hasn't paid the mortgage since he moved out but his name is still on the mortgage. When, if ever, can I remove his things without being a legal issue?
