How is the property settlement determined in abandonment divorces in Texas?
Q. Is an abandoned spouse entitled to keep community property in an abandonment divorces in Texas?
Asked by - Fri Dec 31 16:15:21 2010 - Law & Ethics - 2 Answers - Comments
A. The grounds for divorce will not affect the status of property as community property. However, a judge is free to consider fault in the breakup of a marriage, as well as many other factors, in the equitable division of community property. The division of community property is very much something that is determined on a case-by-case basis. How abandonment may affect the division of property in your situation may be completely different from someone else. Your lawyer will be in the best position to give you guided advice about your particular situation.

How do I fill out a Schedule D for a 1099A - Abandonment or Acquisition of Property?
Q. I have a 1099 A for an abandonment of property. The principle is $7500 and the fair market value is $9900. The original loan was for $8900. Is the cost or basis $9900 or $8900? This was a timeshare that was financed 12-24-2000. What is 3D or 10D?

A. I take it this was a timeshare or a car? schedule d if you owned it for more than a year, long term. description (use 1099-A) date acquired (your memory) date sold (use 1099-A) sales price $7500 (from lessor of outstanding debt/fmv) cost or other basis $8900 (or whatever you paid) gain/loss 0 (7500-8900, but you can't go below zero since personal assets are not deductible). Be sure that 10D (a subtotal field) is filled in.

Paralegals, How do I go about filing abandonment or termination of parental rights of an absent father in OR?
Q. I am inquiring on what I need to do to file abandonment or termination of parental rights, against a father who has never met, seen or acknowledged his daughter who is now 4 1/2 years old. My fiance' is looking to adopt her as well when we get married. I know most will say consult a lawyer locally but I have not had any luck with that so far but will continue the search. I have posted on several law sites as well. Please let me know if you have any information!

A. I agree with KP that it is better to wait until you are married to try to terminate your daughter's father's parental rights. However, below is a link that you can use to research Oregon laws when it comes to termination of parental rights.

What's the different between reckless abandonment and token commitment to Jesus?
Q. I want to know what reckless abandonment and token commitment to Jesus mean, so if you really know let me know.
Asked by maya_my_baby27 - Thu Dec 11 18:34:01 2008 - Religion & Spirituality - 4 Answers - Comments
A. Only God knows if you are truly committed or not, token does not come into it (do you mean money on the offering plate?). If you choose to walk away from God, that's your choice, but He will never walk away from you. Reckless abandonment is therefore far worse.

Acquisition or abandonment of Secured property. Will it affect our tax return?
Q. IF you had a foreclosure on a house and still owed the lender an amount for it...would they take what they can from your tax return? Or is the note I got, just a note for us to take to the tax place when we file. It says it is an acquisition or abandonment of Secured property.
Asked by alw0322 - Fri Feb 1 15:16:41 2008 - United States - 1 Answers - Comments
A. The 1099-A is a "sale." It needs to be reported on your tax return. You probably have a non-deductible loss from this. When you get the 1099-C, then you will deal with cancelled debt.

What if I am in bankrupcty 7 & want to keep the property that they are motioning for abandonment?
Q. If the abandonment is granted, what does that mean for me?
Asked by - Mon Sep 14 14:05:00 2009 - Renting & Real Estate - 1 Answers - Comments
A. The only way to keep property out of bankruptcy would be to pay it off in full. However, since you already filed bankruptcy, it is too late. The court would want the money for the payoff of that property to be distributed properly among creditors. Talk to your bankruptcy attorney. However, you have probably lost that property.

A. I actually just went through this in the state of NY and Sexual Abandonment is grounds for divorce in NY. Is the divorce going to be something you both want... if so you can do it your self without an attorney just go to the court house and ask for a no contest divorce packet... otherwise go directly to an attorney and start the proceedings... I actually did my divorce on the same grounds it took a few years but it is not hard to do... good luck and I hope it all works out for you.

Is there any connection between tattoos and abandonment issues?
Q. I know someone who seems to have a tattoo addiction , they continually want more and more tattoos and never seem satisfied, they also have severe abandonment issues from when they were a child. Their parents divorced and they lived with there mother who would frequently leave them alone for days and even weeks at a time. I was reading something about addictions which stated that people who had them saw some sort of fulfillment in something they were lacking, in this case permanence. Am I reading to much into this or is there something to it?

A. 01. Cover up. That's what tattoos do. 02. Hiding. Tattoos hide skin, which is symbolic of emotions. 03. They should probably see their physician & get a referral to a psychiatrist, since this has become an addiction. Anything to excess is a 'red flag' that there is something deeper going on. Good Luck & Warm Wishes.

Q. I have an online friend who told me it costs $350 to file a child abandonment report. She said she was surprised to find out there was a fee when she recently had to file one. I'm finding this hard to believe and figured I'd ask here to see if anyone knows.

A. If you are talking about a child abandonment police report, there is never a charge to file a police report, it's a crime. If you are talking about something involving an attorney that may be where the $350 comes in. But not for a police report.

Q. I have an online friend who told me it costs $350 to file a child abandonment report. She said she was surprised to find out there was a fee when she recently had to file one. I'm finding this hard to believe and figured I'd ask here to see if anyone knows.
