Q. Is it legal for a rehab facility in Florida to refuse to release a patient unless the family can guarantee 24-hour care for the patient? The patient needed therapy, but got the required therapy and could be released, if the rehab. facility would release the patient. The patient desperately wants to leave the rehab. facility and stay with family, and the family is in agreement, and would take her in, but cannot afford to pay for nursing staff 24-7, so they cannot get her released from the rehab. center. The patient is not in such a condition that she needs 24-7 care of any sort, and is begging her family to get her out of the rehab center and take her home.
