What is the legal definition of abandonment of property?
Q. I notified my landlord that would need to move to another city. I left all electricity on and vacated the premises so he could get a new tenant in. So, my feeling is that this is not abandonment, just allowing him to find a new tenant. He is keeping some of my money per the abandonment clause in our lease that says I have to pay the difference in rent. I would like to get out of this - can someone please explain abandonment and if possible, a source of their explanation. THANKS! I'm in Florida.

A. You abandoned the lease, which is an enforceable contract. The landlord is within his rights and the terms of the lease to keep your money. He can also sue you for breach of contract and any losses he might incur if he does not immediately find a new tenant. If he does find a tenant, but because of market conditions, is forced to charge at a lower rate, you are liable also for the difference in amount. Your only recourse is if there is a clause in the lease whereby you or the landlord can terminate the agreement by giving a specified or reasonable advance notice. Leaving the electricity on does not mitigate your breach of the lease agreement. Abandonment as it is used in a lease is breaching the lease contract without good cause. A good… [cont.]

How to help a six year old boy with dread of abandonment?
Q. My son feels attacks of anxiety when he imagines that we have abandoned him for example if he can't find his parents or if we are late to collect him. He recently saw another man that looks like me who ignnored him (of course), and this triggered an anxiety attack. I feel he is expressing his anxiety through dread of abandonment. I have encouraged him to use plans of action such as seeking help instead, and this is working but only in specific situations where he has learned to do that and then becomes comfortable with a specific situation. For example, after coaching him, he now feels comfortable after his swimming lesson finding his own way back to our seat. When a new different situation arises he again feels the anxiety attack.

A. I think you need to find out why this started. Did he see something on TV or did hear others talking. Children are so intuitive and they pick up on things that we would never realize. I would just keep encouraging him and tell him often how glad you are to have him. He may just be going through a stage.

Q. I am inquiring on what I need to do to file abandonment or termination of parental rights, against a father who has never met, seen or acknowledged his daughter who is now 4 1/2 years old. My fiance' is looking to adopt her as well when we get married. I know most will say consult a lawyer locally but I have not had any luck with that so far but will continue the search. I have posted on several law sites as well. Please let me know if you have any information!

A. I agree with KP that it is better to wait until you are married to try to terminate your daughter's father's parental rights. However, below is a link that you can use to research Oregon laws when it comes to termination of parental rights.

A. Wanna know how I did it? Face that fear head on. Oh trust me, I have had an absolutely insane fear of abandonment since I was a small child. Then, after I was living in a different state than my whole family, my mom killed herself, my husband left me, my friends moved away, and I was evicted from my house. That will lead to a full blown panic attack if you have an insane fear of abandonment. But I was forced to face my greatest fear in the world. And I survived. I'm living testament to my fear being useless. Don't get me wrong, I was pushed to my absolute limits and I damn near didn't make it out alive. But I did. And now, abandonment means so little to me. I'll survive you leaving me. I'll survive having nobody to lean on. I got faith… [cont.]

How do you file for child abandonment in Pennsylvania?
Q. How do you file for child abandonment in Pennsylvania and how long does the other parent have to be gone for before you can file? I have a four month old daughter and i want to move out of state. I need custody to do that but the child's father is no where to be found.

A. Are you married to the father? Assuming you are not, and you are the mother, you already HAVE full custody. If he wishes to challenge anything, it is up to HIM to file.

How many days must an owner not return for his dog constituting abandonment?
Q. I gave my friend a dog. He brings her over every day because she's too much trouble for him to concentrate (I don't know on what). Yesterday, he brought her over and has not come back. He knows she has a vet appointment on Monday. How many days does it take to constitute abandonment if he does not return for the dog?
Asked by Sandee - Sat Oct 3 18:58:45 2009 - - 4 Answers - 2 Comments

A. Why don't you just call your friend and honestly ask him if he wants that dog. You may need to offer to take it back and find a better home for it if you can't keep it. Next time please make sure the person you give it to really wants a dog, it doesn't sound like your friend does.

I need to write up a Abandonment Agreement for the storage company I work for. How do I legally word it.?
Q. I need to have the tenant sign a abandonment agreement for the things he left in the unit so I can empty it. They are 3 months behine and moved to another state. I need to word it legally so I don't get sued down the road.
Asked by Sandra - Thu Aug 27 13:24:20 2009 - - 3 Answers - 0 Comments

A. You might find a number of examples you can use on the web by googling the terms. Or, is it possible to go buy another storage place in the area and ask if you can see a copy of theirs? It isn't really something that would give them a competetive advantage so they shouldn't have a problem sharing it with you. Just some thoughts.

What if I am in bankrupcty 7 & want to keep the property that they are motioning for abandonment?
Q. If the abandonment is granted, what does that mean for me?
Asked by Kesha G - Mon Sep 14 14:05:00 2009 - - 1 Answers - 0 Comments

A. The only way to keep property out of bankruptcy would be to pay it off in full. However, since you already filed bankruptcy, it is too late. The court would want the money for the payoff of that property to be distributed properly among creditors. Talk to your bankruptcy attorney. However, you have probably lost that property.

Acquisition or abandonment of Secured property. Will it affect our tax return?
Q. IF you had a foreclosure on a house and still owed the lender an amount for it...would they take what they can from your tax return? Or is the note I got, just a note for us to take to the tax place when we file. It says it is an acquisition or abandonment of Secured property.
Asked by alw0322 - Fri Feb 1 15:16:41 2008 - - 1 Answers - 0 Comments

A. The 1099-A is a "sale." It needs to be reported on your tax return. You probably have a non-deductible loss from this. When you get the 1099-C, then you will deal with cancelled debt.

If someone wanted to get a divorce for sexual abandonment in NY what is the procedure?
Q. If someone wanted to get a divorce for sexual abandonment in NY do they have to wait out the full year of no sex and then be legally separated for a year to get divorced? or can they legally separate asap?.. What are the procedures?
Asked by Lauren C - Fri Aug 14 13:36:07 2009 - - 6 Answers - 0 Comments

A. I actually just went through this in the state of NY and Sexual Abandonment is grounds for divorce in NY. Is the divorce going to be something you both want... if so you can do it your self without an attorney just go to the court house and ask for a no contest divorce packet... otherwise go directly to an attorney and start the proceedings... I actually did my divorce on the same grounds it took a few years but it is not hard to do... good luck and I hope it all works out for you.

Can a 17 yr old choose to live with a friend without it being technical child abandonment?
Q. i have a friend who wants to live with me, but we live in far away states. my friend wants come when it's close to her birthday but it'll be a few months before. would it be consitered child abandonment by her parents if she lives over here before her 18th birthday?
Asked by Jade - Mon Jan 18 18:43:24 2010 - - 7 Answers - 0 Comments

A. It depends a lot on where she is coming from and where she is going. In some (most) states, 18 is the minimum before a child can relocate without parental consent. It would not be a matter of abandonment, btw, if her state does not allow it, you would be technically guilty of kidnapping across state lines. If her parents agree, they can grant you custody (assuming you are over 18), which will resolve the issue. Also understand that you need to make arrangements for schooling, medical care, etc, which will not be possible without parental consent.

What is the Job Abandonment criteria in CA?
Q. Is there any time frame for job abandonment? I think the family act allows 12 weeks of leave, if an employee didn't show up for work and didn't call, how many weeks is considered job abandonment?
Asked by shulingfong - Tue Dec 16 21:40:09 2008 - - 2 Answers - 0 Comments

A. "A reasonable period". If you've got 12 weeks of family leave, and you're supposed to show up on a specific Monday on the 13th week and don't show up at 9am, the boss can't consider you to have abandoned your job. If you don't come in all day, though, and don't call, he can. If, for example, you've asked for and been granted 6 weeks of leave, you can't just not show up on the 7th week and not expect to be fired because you *could of* asked for 12 weeks not 6. Richard
